CJEU Rules on Reintroduction of Internal Border Checks for Longer than Six Months
On 26 April 2022, the CJEU (Grand Chamber) rendered an important judgment on the interpretation of Art. 25 and 27 of the Schengen Borders Code, which enables Member States to reintroduce internal border checks for reasons of public policy or internal security, while setting up maximum periods in which such controls can be maintained. According to the CJEU, Member States can reintroduce border controls only without exceeding that maximum period of six months unless a new serious threat arises.
