On 07.03.2023, the renewed Schengen Information System (SIS) became operational. The information exchange system contains information on wanted or missing persons, third-country nationals without legal right of residence in the Union and lost or stolen objects (e.g. cars) and can now be used in 30 countries in Europe. An ECA report concluded that the limitations of the legal framework hampered the Commission’s supervision of free movement restrictions imposed by the Member States during the COVID-19 pandemic in 2020/2021. In his opinion delivered on 7 July 2022, Advocate General (AG) Emiliou clarified the obligations placed upon the competent authorities of the Member States in circumstances where an alert has been entered in the second generation Schengen Information System (SIS II) for the seizure of an object or its use as evidence in criminal proceedings, when that alert is no longer considered relevant. Legislation on Information Alerts in SIS Passed

On 6 July 2022, the European Parliament and the Council passed new legislation that establishes the category of “information alerts” for entries into the Schengen Information System (SIS). “Information alerts” target third country nationals who are suspected to be involved in terrorist offences or other serious crime (listed in Annex I of the Europol Regulation 2016/794). CJEU Rules on Reintroduction of Internal Border Checks for Longer than Six Months

On 26 April 2022, the CJEU (Grand Chamber) rendered an important judgment on the interpretation of Art. 25 and 27 of the Schengen Borders Code, which enables Member States to reintroduce internal border checks for reasons of public policy or internal security, while setting up maximum periods in which such controls can be maintained. According to the CJEU, Member States can reintroduce border controls only without exceeding that maximum period of six months unless a new serious threat arises. Read more
