Regulation Implementing the Digital Markets Act (DMA)

On 14 April 2023, the Commission published the Regulation implementing its Digital Markets Act (DMA). The Regulation details procedural aspects related to the implementation and enforcement of the DMA, which entered into force on 1 November 2022 and become applicable on 2 May 2023, e.g. the parties' right to be heard and have file access. It intends to promote effective proceedings and give the involved companies, including those appointed as gatekeepers, legal certainty regarding procedural rights and obligations. The DMA is an EU regulatory tool that comprehensively regulates the gatekeeper power of the largest digital companies in order to make the markets in the digital sector fairer and more contestable (→ eucrim 4/2022, 228-230).
